TRAB Clarifies Issues concerning Trademark Review and Adjudication Cases after Implementation of Decision on Amending Trademark Law

The Trademark Review and Adjudication Board of the State Administration for Industry and Commerce ("TRAB") has issued the Circular on Issues concerning the Trademark Review and Adjudication Cases after the Implementation of the Decision on Amending the Trademark Law (the "Circular").


The Circular specifies that for trademark dispute cases which had been filed with the TRAB and not concluded before the implementation of the Decision on Amending the Trademark Law (the "Decision"), the TRAB shall, after the implementation of the Decision, hear such cases with reference to the rules for hearing trademark invalidation cases and render adjudications regarding the requests for invalidation. Where the TRAB makes an adjudication regarding a trademark opposition request before the implementation of the Decision and a party involved receives such adjudication prior to May 1, 2014 (excluding May 1), the party may apply for review of the adjudication, and the TRAB shall accept such application if it is filed within the statutory 15-day time limit.
