Final Trial by the Guangdong Higher People’s Court: Trademark “非诚勿扰” is Not Infringing
A trademark infringement case involving the dating program “非诚勿扰” (“You Are the One”), broadcast by Jiangsu Satellite TV, was finally concluded in a manner that allows the program to resume the use of its name. After trial, appeal and retrial proceedings, the Guangdong Higher People’s Court issued a final judgment on December 30th, 2016, ruling that the alleged conduct of Jiangsu Satellite TV does not constitute trademark infringement.
The party alleging infringement against the program is an individual named A Huan Jin from Wenzhou. After the movie “非诚勿扰” directed by Xiaogang Feng became a bestseller in 2009, Jin filed an application with the China Trademark Office (the “CTMO”) for registration of the trademark “非诚勿扰”. The financial reporter discovered through inquiry with the China Trademark Office under the State Administration for Industry and Commerce that Jin’s trademark application for “非诚勿扰” was filed on February 16th, 2009 and the trademark was approved for registration on September 7th, 2010.
