Latest Session of the China Law Salon: “Patent Infringement Practice”
On July 29th, 2016, W&B hosted the latest session of the China Law Salon, entitled “Patent Infringement and Litigation Practice”. This topic was selected for the purpose of propagating the understanding of intellectual property rights infringement and litigation practice and to meet the needs of our clients and their industry colleagues in their daily operations. The lecturer on this occasion was Mr. Huang Jianguo, a W&B partner and a highly experienced attorney in this field.
Mr. Huang began his legal career as an attorney specializing in patent litigation in 2007. He has provided his legal services in lawsuits involving a number of Fortune 500 companies and well-known domestic enterprises. Many of the cases in which he represented clients were selected by the Supreme People’s Court as example cases for their respective years. Mr. Huang divided the lecture into three parts – (i) a brief introduction to the determination of patent infringement, (ii) the identification of the scope of patent protection, and (iii) the rules for the determination of patent infringement. He illustrated his points with cases involving the infringement of patents for the invention of solenoid gas valves and sewing machines, as well as a case involving the of infringement of a design patent for a packaging cup, all of which represent typical W&B cases. Mr. Huang provided advice on the main infringement determination issues involved in tackling litigation related to patent rights.
Representatives from various companies listened attentively and raised a number of questions during the two-and-a-half-hour session. The participants demonstrated their tremendous enthusiasm by continuing their discussions with Mr. Huang after the lecture was concluded.
