At the invitation of the IP Research Committee of the Shanghai Bar Association (SBA), on March 4, 2016 W&B Senior Partner Jean Yang attended a meeting to discuss the Anti-Unfair Competition Law (Amendment for Deliberation) as a member of the board for the promotion of lawyers’ participation in political affairs under the SBA.

As the keynote speaker for the session, Jean Yang provided detailed information regarding the basic facts, history and background of the revision and functioning of the Anti-Unfair Competition Law. She joined other board members in examining, studying, discussing, and providing perspectives and suggestions in connection with the entire revised draft.

The current Anti-Unfair Competition Law, which functions as a “fallback provision” for every aspect of business operations, offers comprehensive protection of intellectual property rights, and it can serve as a primary legal basis for protecting business operators’ legal rights and interests. In the meantime, as various legal issues keep evolving on topics such as the concentration of business operators, commercial bribery, trade secret infringement and business model plagiarism, the revision of the Anti-Unfair Competition Law will directly impact competitive relationships and the legal liability of businesses, individuals, other organizations and consumers.
