Who Moved Whose Cheese? – A Battle between Game Providers and Copyright Holders

  Video games, especially mobile client-based games, have undergone explosive growth over the past two years. Tremendous market demand has compelled numerous game suppliers to launch a great number of products within a very short period of time. Some of these products are created by “referencing” other games or other works. In the meantime, today’s video games have taken on the distinctive characteristics of fast-moving consumer goods -- short life cycles and simple game structures -- which in effect limits the diversity of their forms of expression. The intersection between “referencing” and limited forms of expression has become a battlefield within which game suppliers and copyright holders scramble for advantage. What is the best way to win this battle and maximize the interests of the parties concerned? The Salon will discuss this issue and provide insights through case studies based on fundamental copyright principles.
