NPC Standing Committee Adopts the Data Security Law

The 29th session of the Standing Committee of the 13th National People's Congress ("NPC") recently adopted the Data Security Law of the People's Republic of China (the "Data Security Law"), which shall come into effect from September 1, 2021.

 

The Data Security Law establishes the basic systems for classified and graded data management, data security risk assessment, monitoring and early warning, emergency response and data security review, and clearly defines the data security protection obligations for relevant subjects. Compared with the its second draft for review, five revisions are made, including adding the provisions "data that have a bearing on national security, lifelines of national economy, people's livelihood and major public interests shall be subject to stricter management system".
